Terms & Conditions

By placing an order via this website, you accept these terms and conditions. To order items through this website you must be at least 18 years of age. We will treat each order for items as an offer by you to purchase the goods subject to these terms and conditions. A contract between us only arises upon our acceptance of your order. We have the right to refuse at our discretion to supply any products ordered by you.

Description of goods

All descriptive matter, specifications and advertising are only for the purpose of giving an approximate description of the items. Every effort is made to ensure images give a fair representation of the actual product but complete accuracy cannot be guaranteed.

We try to ensure everything on our website is accurate and up to date. If an item has the wrong description, is unavailable, or is mispriced we may not accept your order for such an item, but may contact you to confirm any inconsistency of description or price.

Payment method

We accept the following methods of payment:

  • Stripe
  • For the UK, Australia and North America, we can send out an order with an invoice to be paid by Stripe or bank transfer.

If Stripe refuses to authorise payment to us, we will not be liable for any delay and/or non-delivery of your order.
Payment must be made in the currency of the country in which you are having the order delivered.

International Orders

Orders for despatch to destinations outside the UK, North America and Australia cannot be accepted through this website, due to the fluctuation in delivery costs. For such orders please email us with details of what you wish to order and where we would be sending it to.  We will then advise you of the delivery charge and at that point you can decide whether or not to proceed with the order.

Destinations outside the EU may be subject to import duty. These are not included in our prices and are the responsibility of customers to pay on or after receipt of goods.

Availability of goods

All products are subject to availability and any product may be withdrawn at any time.

Delivery, Short Delivery & Non-Deliveries

We will use our reasonable endeavours to delivery your order within 14 working days.
Delivery will be made to the address supplied by you.
For security purposes, we do not deliver to P.O. Box numbers.
If delivery cannot be made to the address supplied by you the goods will be returned to our distribution warehouse and any further delivery will incur additional delivery charges.
We may deliver fewer items than those ordered if there are shortages of stock. We will deliver the balance of goods to you when they become available.
Where appropriate all items must be signed for by the customer upon delivery. If an item is lost in transit we will use the track and trace service offered by our courier company. If the parcel is not recovered we will resend the items at no cost to you.

Shortage

It is your responsibility to check and sign for the correct number of packages as shown on the delivery or carrier consignment note. If you suspect that there are items missing from the delivery, first check that the order has not been partly shipped. Any shortage must be notified to us within 2 working days.
If we are not notified of a shortage other than as a result of part shipment within 5 working days of delivery then it shall be deemed that full delivery has taken place.

Events beyond our control

We are not responsible for any delay or failure in carrying out our duties under this Agreement if the delay or failure is caused by circumstances beyond our reasonable control. These circumstances include civil commotion, riots, flood, drought, fire, fault of the postal service or the courier service, strikes, and machine breakdowns.
You must allow us reasonable time to carry out our duties in these circumstances.

Privacy

We only use your details to fulfil your product and service orders: our obligations under this agreement include but are not limited to the disclosure of your personal data to the companies and organisations engaged to supply and deliver the product to you including without limitation printers of the products, couriers and other relevant postal authorities, any other person and/or organisation engaged by us to fulfil your order and all other relevant authorities who are entitled to or to whom we owe a legal obligation to the disclosure of your personal data. You acknowledge that after having been advised of the purposes and circumstances under which your personal data may be used, processed and disclosed to other parties as detailed in these terms and conditions and on the web site you explicitly consent to the disclosure and the transfer of your sensitive personal data to the printers of the products, and relevant postal authorities.
We do not pass on any details to third parties for marketing purposes.

Your private financial data is not stored by us or shared with any third party company.

Financial Data Privacy

We will not store your financial details on our web server or local machines. If ordering via telephone your transaction will be processed immediately and your financial details will not be stored.
If you pay online you will be redirected to a secure server and no financial data, logins or passwords are captured by us.

Promotional Discount Codes

We may occasionally offer promotional discount codes to registered members. These codes may only be applied to purchases made through the member account to which the discount code was offered.
We may occasionally offer promotional discount codes which can be applied to any, or to certain specified purchases made through the website. Only one promotional discount code can be applied to any one order.
Specific Terms and Conditions may apply to certain codes and these will be specified at the time of issue. Promotional discount codes are not available for use by distributors, bookstores or stockists.

Governing Law and Jurisdiction

Our agreement with you shall be governed by and construed in accordance with the Laws of England and Wales (Sounds-Write UK), Laws of New South Wales (Sounds-Write Australia) and laws of the State of Delaware (Sounds-Write America).

Your use of the Website and making Orders may also be subject to other local, state, national, or international laws.

For UK orders, you agree for all purposes to the non-exclusive jurisdiction of the Courts of England and Wales.

Distributors, bookstores and stockists

All our terms and conditions, as described above, are also applicable to distributors, bookstores and stockists.

Statutory Rights

These terms and conditions do not affect your statutory rights.

Sounds-Write Packages Terms & Conditions

MAT/Districts

You acknowledge and agree that by signing up to the MAT/District Package you commit to onboarding a minimum of two (2) schools within your MAT/District to undertake the Sounds-Write Training on the basis that each school signed up for the package commits to training at least five (5) members of staff on Sounds-Write Training over a two (2) year period. The two (2) year period shall commence on the date that the first trainee from one of the schools within THE MAT/District package attends the Sounds-Write Training (“Training Window”). In the event that fewer than five (5) members of staff from each of the schools signed up for the package within the MAT/District undertakes the Sounds-Write Training within the Training Window, you will be liable to Sounds-Write for the per head training fee payable for each member of staff not trained, calculated in accordance with Sounds-Write then-current prices.

 

Schools/Organisation package

You acknowledge and agree that by signing up to the Schools/Organisation Package you commit to submitting five (5) members of your organisation’s staff to complete the Sounds-Write Practitioners training course (“Sounds-Write Training”) over a two (2) year period and using best endeavours to ensure that each member of staff completes such Sounds-Write Training. The two (2) year period shall commence on the date that the first trainee attends the Sounds-Write Training (“Training Window”). In the event that five (5) members of staff do not undertake the Sounds-Write Training within the Training Window, you will be liable to Sounds-Write for the per head training fee payable for each member of staff not trained, calculated in accordance with Sounds-Write then-current prices.
